Sandusky attorney launches ‘proper shower technique’ defense

With each passing day, this Jerry Sandusky rabbit hole continues to get deeper and darker.  And a whole helluva lot more disturbing.

In an interview with WHTM-TV, attorney Karl Rominger, the newest member of the former Penn State defensive coordinator’s defense team, offered up an interesting — and creepy — explanation as to why Sandusky showered alone with boys as young as 10 years old he had met through his Second Mile charity.

“Some of these kids don’t have basic hygiene skills,” Rominger told the television station, presumably with a straight face throughout. “Teaching a person to shower at the age of 12 or 14 sounds strange to some people, but people who work with troubled youth will tell you there are a lot of juvenile delinquents and people who are dependent who have to be taught basic life skills like how to put soap on their body.”

(In the interest of fairness, we’re going to assume Mr. Rominger is a real attorney with a degree and everything and not a well-executed plant from The Onion.)

In an apparent effort to bolster this latest defense tactic, Rominger noted during the interview that his college cross-country coach often showered with the team.  Of course, Rominger was neither 10 years old nor alone when these showers took place, so it’s unclear what his college experience has to do with his client’s situation.

Sandusky has admitted in previous interviews that he showered with boys and engaged in horse-play with them while showering, although he did concede that he “shouldn’t have showered with those kids.”  In the original 40-count indictment against Sandusky, a witness alleged to have seen the retired assistant sodomizing a 10-year-old boy in the shower of Penn State’s football building in 2002.

His answer to — or more specifically, the hesitation in answering — the question posed during his interview with Bob Costas of whether he was sexually attracted to young boys was the final nail in the coffin of public opinion.

Rominger seems to think Sandusky’s lack of eloquence, rather than his alleged actions, is working against his client.

“The problem is if you’re an innocent person who’s not articulate, you’re not going to come across well, but you’re still innocent,” Rominger said. “A guilty person who is very articulate might come across innocent. So it’s not a fair fight.”

Earlier this week, Sandusky waived his right to a preliminary hearing in which he likely would’ve faced at least some of his 10 alleged victims.

UPDATED 5:57 p.m. ET: If backpedaling were an Olympic event, Rominger would be the prohibitive gold-medal favorite at the 2012 London games.  The following is comes from the Associated Press.

“Rominger said in a statement Thursday that he only was giving a hypothetical example of why a person might shower with an adolescent. He noted he never said Sandusky touched boys in a shower.”

I’m no lawyer, and I didn’t sleep at a Holiday Inn Express last night, but my legal advice to the lawyer would be to shut the hell up on all fronts.  His mileage may vary, however.

    Attorney Karl giving an interview to WHTM-TV? That is going to help his client? What a disgrace and perversion. Excuse Sandusky showering with young children to teach them proper soaping techniques? Surprised the interviewer did not just start vomiting. I guess the pervert’s lawyer has to come up with some excuse. This will never make it to a jury trial but if it did, the jurors would likely have to hold back nausea.

    I think the attorney has been smoking some of that funny weed. Did he let them use his soap, or, buy them, their own personal bar? The man he is defending is a very sick individual, and this old crap, about everyone deserving to have a defense stinks sometimes. I realize it is one of the main stays under our constitution but what kind of lawyer comes up with crap like that, and would even defend this guy. I think he needs to go to prison and spend sometime with a cellmate named Bubba. They would make a good pair.

    How Sandusky presents himself to the public wouldn’t be an issue if his attorneys were smart enough to remember that he has the right to remain silent. They’re the ones who keep babbling in front of every camera and mic they can find. I believe strongly in the presumption of innocence. But when this adult man admits “horsing around” in the shower one-on-one and getting touchy-feely with children who’ve accused him of abuse, what does he expect people to think? I’ve read accounts of pedophiles who actually tried to argue that preschool girls were coming on to them. Sandusky and his attorneys sound just that delusional.

    This falls into that “yeah-I-bought-my-mom-a-baseball-glove-for-her-birthday-so-I-could-teach-HER-how-to-play” category. What are these idiots thinking? Shut the —- up already. Even my kid brother figured out I bought the baseball glove for ME to use.

    We have to endure (as do the victims) this circus of lunacy for about another year and know that it only helps to cement the case against Sicko. At some point, Sicko will be able to experience all he’s done from the victims’ perspectives. I just did 70 days in Orange County for DUI. Prison justice is very real, somewhat fair and extremely brutal. Isolation is a joke and nobody cares. Sicko will get it all back to the 10th power. It doesn’t matter how we feel about that, it is a fact of life.

    So, when he gets caught dead to rights on sodomizing that one kid, is he going to claim that he was just showing the kid what could happen to him if he ever committed a crime and got sent to prison? Sandusky is so obviously guilty that it is only a matter of time until he gets convicted. He may be “innocent until proven guilty” but that’s a mere formality. Can we get an expedited trial so that the justice system can conclude what the rest of us already know?

    The ONLY good thing that is coming out of this prolonged circus is the heightened awareness that is resulting from the massive news coverage. Parents should take every opportunity to teach their kids what to look for and how to properly report any shorteyes that every tries anything improper on them.

    So, based on the testimony in the grand jury indictment, he was simply demonstrating the “rhythmic slapping” soap application technique, which is best utilized will being pressed up against the wall of the shower. Got it. Now it all makes perfect sense! He’s obviously innocent!

    @bennyh55311, I agree with your statement, but the fact remains, everyone is entitled to a lawyer. Most will do it for the money and TV time but, even if they all rejected him, a Judge will eventually force someone to represent him.

    The presumption of innocense only applies to the government in how it deals with criminals, no punishment until you get a conviction. In the court of public opinion we are all free to conclude what we wish based on our limited knowledge. Having said that…

    Sandusky’s lawyers are as screwed in the head as Sundusky is himself. You don’t have to be in the shower with the child to show them how to clean themselves properly, duh. No one, and I mean literally no one on planet earth, who is not a member of NAMBLA would ever buy that garbage.

    These lawyers know that all this is public record, if they DO go to trial, all this WILL get before a jury… which tells me that the slimeball IS going to plea bargain. Let’s hope the DA tells them no way, this is going to trial so the world can hear it all.

    It doesn’t work that way. If he wants to plead guilty, the DA isn’t going to tell him no. And having to tell the world their personal nightmares isn’t in the best interest of the victims. It would be better for them if they could get a guilty plea and see him punished without having to go through the long trial and appeal process–or heaven forbid, risk an acquittal (remember O.J.?). I just hope whatever happens that it results in him being locked up for what’s left of his miserable life.

    Now, where in this country are there 12 people who haven’t heard of this case? Where in this country are there 12 poeple who haven’t formed an opinion of Jerry’s guilt?

    If 12 people can’t be found, this animal will be freed on a technicality because he is ENTITLED to a jury trial.

    Every time any of them open their mouth to make excuses why this animal was naked in the shower with little boys, they perhaps reach more people who may not have heard the previous excuses and statements.

    How many lawyers would let their client give interviews? Stupid lawyers? I think not – they’re stupid like foxes in the hen house.

    In 35 years as a Criminal attorney I’ve never seen such ineptness from a defense team. From allowing their client to conduct 2 national interviews, with little or no preparation, to the ludicrous statements made by them, i’m appalled. There are handling this case like two kids just out of law school.
    While this POS will ultimately spend the rest of his life in prison, it shouldn’t be as a result of lawyer incompetence.

    Karl Rominger hosts/used to host a one-hour talk show on a Harrisburg radio station, entitled “the weekend something or other.” I think it airs/aired live on Saturday afternoons and is/was replayed early Sunday mornings. Callers got free general legal advice and were encouraged to contact his office for advice more specific to their situation.

    Just for the sake of fairness,
    The rationale of showing someone how to shower is not a wild ass fiction created to save Sandusky.

    In the 1994 auto-biography of British SAS soldier Andy McNabb called “Bravo Two Two” the author describes his career in the British Army prior to his selection and training in the elite Special Air Service. In it, he recounts as a corporal in charge of new recruits, having to go take a shower with them to show them the proper methods of hygiene.

    Read the book if you want to know the details, but the point is that even if Sandusky is a Pedo, the argument about teaching hygiene IS valid, as supported by totally unrelated sources.

    I know everyone is entitled to a fair defense and most defense attorneys are just doing their jobs when they put forth ridiculous claims in support of their client’s innocence. However, this is above and beyond ridiculous. This is disgusting. Sandusky is a worse human being than his defense team, but not by much. They are all wastes of human life as far as I’m concerned.

I find it so disturbing that Amendola calls his client, “Jerry”. It just weird. It sounds so personal and considering Amendola also lacks a moral barometer it continues to add to the “Eww” factor. Where in the world did he find these “lawyers”?

    I just figured it out – the only thing that makes sense. The lawyer is also a pedophile. The lawyer keeps allowing Sandusky to “justify” his actions – because the lawyer believes they are justifiable. And so a “teaching them how to shower” defense makes perfect sense to him. Everything he’s done up until now shows he sympathizes with Sandusky on a disturbing level. I think the prosecution needs to have this lawyer followed and photographed.

    @humbermk4 – There’s a HUGE difference in an ADULT Army non-com having to teach new ADULT recruits proper hygiene. That happens with a whole group of soldiers, who always shower together anyway, and presumably, the instructor didn’t have an erection though the entire process.

    Also, military organizations around the world all have some crazy and antiquated regulations on the books that have to be followed and this seems like one of them. Back in the early part of the 1900s to well into the 1960s, a lot of lower income British subjects didn’t follow proper hygiene. The entire family took a bath, once a week, all in the same bath water. Ever hear of “don’t throw the baby out with the bath water?” That’s where that came from. A lot of those men really didn’t have proper hygiene when they went into the military. This certainly NOT the case with Sandusky and these boys, not even close.

    I really can’t see a plea deal coming. What’s the difference between spending the next 50 years in jail or the next 300. Either way he will be dead behind bars.

    By going to trial his lawyers give themselves a shot at getting him off (no pun intended), which in turn would open up book deals and the like, which all equals more money, THE ONLY THING a lwayer cares about.

    Whoa. My brother and sister-in-law are criminal defense attorneys and I know what my brother went through when he was assigned a molestation case early in his career. Money is not the only thing every lawyer cares about. And frankly, I don’t see any indication that these two boobs could string together enough coherent words to make a book.

    This isn’t about poisoning the jury pool, either. If they could come up with 12 jurors for the O.J. Simpson case after the whole nation spent hours watching that Bronco “low-speed chase,” they’ll come up with 12 jurors for Sandusky. These lawyers really are that incompetent. Good lawyers would keep their mouths shut and require their client do the same.

    Many things could be said about the activities of the British SAS, but for this topic, they’re adults. And I imagine they learned their hygiene practices as a group–not in one-on-one showers with their commander. Somehow I doubt anyone could use that example of overzealous military training to justify an adult male “horsing around” in a shower one-on-one with a 10-year-old.

    Very close to one actually. He impregnated a 16 year old client who he eventually married (but they have sinced divorced.) The client was seeking to get emancipated from her parents in 1996.     This story has gone WAY beyond disturbing and, as for the conduct of the people immediately involved, WAY beyond stupid.

    I grieve for the children in Pennsylvania. If they don’t get “role models” like Jerry Sandusky to “help” them, then maybe they get judges like Mark Ciavarella and Michael Conahan to “set them straight” (you can look up those two assclowns on Google). Or maybe they can REALLY “get a break” by working for Joe Amendola, and having his baby, as reported in the NY Daily News link shown above.

    Seems to meas if the kids in the Keystone State better hope that their families can look after them.

    Sorry to tell all of you looking for prison justice, aint gonna happen. It’s a 100% certainty that he will be kept separate from the general population. No ifs, ands or buts. Hell, they likely would keep him in isolation just because of his notoriety. There no question he’ll be kept in segregation as a child molester.

    Sandusky has one last chance to do something honorable here before revictimizing these young men. Forcing them to relive these events during depositions and testimony can be avoided. And he can save taxpayers a bundle of money at the same time. He should have done it while he was still out.

    Second, lawyermalloy is right – terrible lawyering all over the place here. But, like I said before, this particular brand of cesspool ooze (Sandusky) deserves the attorneys he has.

    Last, if Karl Rominger was giving away free legal advice on the radio, then let me be the first to suggest that such a cost was way too expensive.

    I was molested as a child by a vice principal and I can still hear him using the word “hygiene” to lure me into a shower where he stole my innocence and ruined me for life.

    Jerry Sandusky is a sick pervert that deserves to spend the rest of his natural life behind bars. I am sure there are people behind bars in the Penn State Prison System that are waiting for the oppurtunity to show Jerry the proper way to wash behind his ears.

    Proper showering technique. A step-by-step guide:

    1) Stand underneath running water
    2) Apply soap to body
    3) Allow running water to remove soap from body
    4) Turn water off
    5) Dry body with towel

    Looked it up on the Internet. Nowhere in the steps referenced did it make mention of having another man’s penis inserted into your rectal cavity. I checked. Twice. No mention of it anywhere in the instructions. What did I miss?
