Some want criminal investigation over assault video from night of BCS title game

Alabama walked away from the BCS championship game last week with a 21-0 victory over LSU, but the joy of their second BCS title in three years has been dampened by a viral video showing an Alabama fan sexually assaulting an unconscious LSU fan.

Some background: the video taken from a cell phone first appeared on the YouTube channel for “BamaSportsForum” (which has since been deleted) and was picked up by Deadspin.com two days ago. The incident took place at a Krystal restaurant on Bourbon Street the night of the BCS championship game.

The video, about five minutes long, features several Alabama fans hazing, poking and taking pictures of the unconscious man. Then, one individual exposes himself and places his genitals on the unconscious fan before a restaurant employee steps in to disperse the crowd.

The video, as one could imagine, has caused an outrage among both programs and fan bases, and at least one local figure wants a criminal investigation of the incident. From WDSU in New Orleans:

“The fact that it could happen with that additional amount of police officers being available is absolutely appalling and the reaction to it, to me, is pretty appalling,” said Dale Standifier with the Metropolitan Center for Women and Children.

New Orleans police said their Sex Crimes Unit was aware of the incident and was waiting to be contacted by the victim before taking action.

“The man was obviously passed out, intoxicated and unable to defend himself, and he was assaulted,” Standifier said. “He was sexually assaulted, and humiliated and tormented while people cheered, and he shouldn’t have to stand up for himself and say, ‘I want to press charges.’ The city should be pressing charges and trying to move forward. If you had a murder victim, you can’t expect the victim himself, the corpse, to testify.”

Remi Braden, a spokesperson for the New Orleans Police Department, says the head of the Sex Crimes Unit is aware of the video and has reviewed it, but that all involved, including the victim, are unknown and no one has come forward to file a complaint.

“In sexual assault cases, victims make the ultimate decision to inform police so that we can thoroughly investigate a situation.Should that person in this video decide to come to us, we will launch a complete investigation,” Braden said.

Alabama has issued a statement on the video, which reads:

“UA hopes that our fans will act with class and dignity and we are disappointed when they don’t. We are aware of the video… and will appropriately deal with any student who might have been involved.”

It’s unknown if the individual who assaulted the fan is a student at Alabama.

LSU has chosen not to comment on the video at this time.

    When traffic cameras are installed at busy intersections, drivers eventually learn to strictly obey the law when passing through. Hence, over time continuous monitoring reduces the number of traffic violations.

    At some point people are going to realize the same thing applies in regards to cell phone cameras. It makes no sense to act illegally when literally dozens of people could be recording your actions for the world to see.

    I hope they prosecute the heck out of that guy and set an example for the rest of the drunk morons out there.

    Just curious, but had neither fan,been wearing team apparel, would it been any less heinous. Sorry, but this is not a reflection of Alabama, or college football fans in general. Just a drunk jerk behaving as such.

    This is jacked up greatly!!! but no one is bringing up that LSU fans were throwing dead animals at people in the parking lot at some of their home games this year!!! either way fans of ALL teams need to get a grip they are not the ones playing the game and act like adults

    I hope they catch the guy along with his friends. Harvey would be proud of this guy.

    What I don’t get is the guy who finally pulled his pecker out wasn’t the first guy on the video to reach for his zipper. I can’t say it would ever cross my mind to do what they did no matter how much or how little I had to drink.

    If they can identify the people responsible for this action from the video, can’t they at least be charged with indecent exposure, and depending on who witnessed it, it could become a felony if there were minors present. I think the police are just hoping, that all will quiet down and this sad incident will go away. I can understand the outrage, but I wonder why the alleged victim has not come forward. Maybe he is ashamed or so humiliated that he hopes it just goes away. It was a damn dumb thing to do, no matter if they were students or not, but until identified, it could just be another fan, that is not for sure a student and is another Harvey type character.

    It speaks volumes that no Alabama fan bothered to stop this perverted behavior.

    And from watching the video, there appears to be plenty around giggling and laughing at the sophomoric behavior.

    The school should take the lead in hunting these fools down and prosecuting them. It would put them in a better light.

    You know it SPEAKS VOLUMES that this occured in a part of the country where you get rewarded for exposing yourself. Maybe New Orleans should stop that BEHAVIOR, it would put them in a better light.

    I am not condoning this guys behavior in any way shape or fashion. What he did was horrible. I just can’t stand it when people get on their freakin’ high horses after something like this happens just because the guy was an Alabama fan. If it had been a fan of their favorite team they wouldn’t have lifted a finger toward their keyboards and they know it.

    You know this isn’t even the whole story of what happened that night. Has anybody seen the interview they did with the passed out guy’s girlfriend?

    Why would the NOLA police need the victim to come forward? They have VIDEO of it happening. They do not need “[the] victim [to] make the ultimate decision to inform police so that [they] can thoroughly investigate a situation.”

    This makes sense in a typical sex assault case where there are no witnesses and they will only become aware of the incident if the victim “informs police.” But here, there is no justification for requiring the victim to come forward. There was a clear crime committed (pretty vile crime, too), and they are obviously aware of it.

    Stop making excuses and do your job, NOLA police.

    First, there were more than a few clowns wearing Bama gear and acting like idiots in the video. Second, there has been more than one public incident of a Bama fan acting like an idiot in the past year.

    I’m not suggesting that all Bama fans are idiots but they really should make an effort to police their own….instead of treating them like celebrities when one of them does something stupid (think Harvey Updick in New Orleans) if they want to distance themselves from the actions of those types of fans.

    You have to have a complaining victim before the police can press charges of sexual misconduct. Of course, it also helps if the police actually knew who the person who was assaulted is, let alone the perpetrator, who has probably long since left the NOLA police’s jusidiction.

    In any case, as disgusting as this incident is, it’s pretty tame in comparison to what usually happens on Bourbon Street. Go to Mardi Gras next month or Southern Decadence on Labor Day weekend for plenty of prime examples. New Orleans is called “The City That Care Forgot” for a reason, y’know.

    They found out later a ‘Bama fan had painted a 50 yard line in the parking lot.

    You can’t possibly in any shape or form, justify this guys actions, just because the guy was drunk. Did him being drunk justify this guys lewd behavior. Suppose a kid had observed this? You could be talking a felony then, and possible inclusion on a sex offenders roster. Would the supposedly funny act, justify the end results then? He may not be even a student but some attempts at humor, no matter this fans affiliation with the school, far exceed acceptable social behavior.

    kinda funny in the sense that there was all this negative talk about the “savage” WVU fans and the fights and the beer drinking and how the SEC was too proper a place for them.

    i’d rather have a bunch of drunk rabble-r0users who can somewhat handle their beer then a bunch of holier than thou bible thumpers who take one drink and let their true pervert flag fly. but that’s just me.

I know the thumbs-down are because of the seriousness of the incident, but if this was posted on a story strictly about the game, I’m sure you’d be getting mostly thumbs-ups. Let’s face it, it was funny. Unfortunately, the actions described in this story are not. Makes you wonder: what goes through a person’s mind right before they unzip their pants in public, and what are they thinking when they put their penis on another person’s face? Pretty sad commentary on humankind.

    I am far from an Alabama fan I assure you, but these idiots actions nor more represent the majority of teams fans in the SEC, than the mountaineers fan are solely represented by those few fans that you cite. Bible thumpers as you say, is also a total misrepresentation of all people in the south as well. Religious beliefs don’t figure in the equation when you are talking about misbehaving fans of any conference or team.

    Agree with you there. SEC football fans are sometimes a rather unique group as it pertains to their particular school, and it sometimes seems that trying to run an honest program is considered a sin amongst some of them. As a fan of college football in general, I try and enjoy watching a good game, no matter the game, or opponents. Of course, when my DAWGS play, I do watch a little closer, and with more interest.
    The man that raised me, was from West Virginia ans they hold a little place in my heart as well. He might have not been my real father, whom I never met, but he had a big heart and great morals in life, and his mom was a gem.
    Good luck to your team in the big 12, and I hope you can get away from the Big East/West/anywhere we can find a team, league.

    Two of the people in the video were identified, not the teabagger but a guy who was about to teabag him and his girlfriend. He is an Alabama sportscatster’s son who actually reported on the video with his son in it.

    Every single team has fans that are completely out of control, are incredibly rude and obnoxious. There is no way to control it, there is no way to avoid it. It is what it is. To condemn and entire program and its fans based on a few idiots is just plain wrong.

    If they actually identify those involved and their are charges that can be filed, then do it. Otherwise, nothing to do but file this under the category: ‘Things that happen when you drink so much liquor that you pass out in a crowded bar surrounded by other drunken fans of your opponent after a football game’

    If you actually went to college, had crazy friends, and partied, then you probably have had a similar experience or took part in shaving somebody’s hair/stache, or coloring graphic pictures on their face with a Sharpie.

    Ok, this is pretty ridiculous, but I can’t seriously imagine the victim is going to come forward and press charges. He drank himself into oblivion and became the town fool for the night. At which point a bunch of others made fools of themselves.

    Anyway, once he comes forward he’ll be forever known as the guy who drank so much he got tbagged. I’m not sure what’s worse – what actually happened or the whole world knowing it happened to you. (meaning that guy, of course).

    I think that’s what we might call the ultimate embarrassment for all involved.

    First of all the state dosent need the victims name to file charges, the state can be the complainant.

    Second this guy, who they are close to identifying, will be labeled a sex offender for life and go to jail for a while.

    Third, those other Bama fans nearby will be dragged into this case for the next 3 years.

    Not so funny anymore children is it?

    I’ve been to NOLA, as well as many other countries, and I can tell with 100% certainty, people would’ve watched and done nothing regardless if they had on Bama gear, Tommy H gear, Polo’s, etc. Its a human race thing. Get your head outta your rear end.

    There is a difference between being a casual observer of an event and being a direct or indirect participant. Most of the Bama fans I saw in the video were either actively participating in the assault or were indirectly participating by trying to incite or encourage the perpetrator.

    It may be a “human race thing” for you and the crowd you associate with but decent people would have come to the aid of an incapacitated person instead of rubbing their genitals over them and would have stopped someone else from doing it.

    My head is not in my rear end but from your comments, it seems like your head has been in your rear end so often that it would be impossible to tell the difference between the two.

    Wow … stay off the blogs a few days and just look at the stories that pop up. And of course, here is saintcasey. While I and other Bama fans posted our congrats to LSU within five minutes and throughout the day following the November game, she has been absent since the championship and has not posted one word of congratulations to the Alabama team because–like many of her fellow LSU fans–she is a simply a bad sport. But let one incident of idiotic behavior occur, and here they are, back on their soap boxes. No, saintcasey, how could a Saints fan be held responsible for his murderous actions if they didn’t occur in New Orleans? :roll:
