Bama fan pleads guilty to two counts of obscenity for BCS championship video

Nearly a full year after an Alabama fan was recorded while placing his genitals on an unconscious LSU fan after the BCS championship game, we have some resolution and can officially put the matter to bed.

So to speak.

Brian Downing of Smith Station, Ala., pleaded guilty to two counts of obscenity for sexually taunting, according to the Associated Press. Prosecutors said a deal was reached Tuesday before trial began.

Additionally, the LSU fan is suing Downing for “mental anguish, humiliation, embarrassment, anxiety and depression … damage to reputation”, among other things. No dollar amount has been attached to the suit.

The video, about five minutes long, features several fans hazing, poking and taking pictures of the unconscious man. Then, one individual — supposedly Downing (pictured) — exposes himself and places his genitals on the unconscious fan before a restaurant employee steps in to disperse the crowd.

Downing has reportedly already lost his job over the incident and faces two years in prison.

    Downing’s plea will make the LSU fan’s (victim’s) law suit much easier and truly a “fete accompli” case, only the amount of award in question.

    Is Downing going to relocate to Louisiana as Harvey Updike the Toomer’s Corner trees poisoner has done?

    So being so stupidly blind drunk that you passed out doesn’t cause mental anguish, humiliation, embarrassment, anxiety and depression and damage to your reputation? Among other things, of course. Yeah, good luck with that lawsuit.

    southernpatriots, last week, Harvey Updyke relocated back to Alabama, at least for awhile. He’s in a state psychiatric facility in Tuscaloosa undergoing mental evaluation.

    Of course..THE SWAMP PEOPLE….”Choot ’em Lisabeth” Swamp People. “Cought dem gators!” “Frankengator” Swamp People….ha. They are really a hoot!

    With all we often have to deal with here…for years the “best politics money could buy,” Hurricanes, losing land the size of the state of Rhode Island due to coastal erosion, etc. we need characters like The Swamp People, Cajun Justice, Cajun Pawn Stars, and of course, I can’t forget the ZZ Top posterity in Duck Dynasty.

    Gotta go for now, have to monitor the meats we are serving for lunch and help more today since some of our volunteers are delivering blue tarps.

    While I am sure I will get blasted for saying this, 2 years in prison seems over the top to me. Both the Tea Bagger and the Tea Baggie were just a little inebriated to say the least. Granted the act was despicable but 2 years in prison??

    Alcohol should be illegal

    WingT: Only a moment here, but he won’t get 2 yrs. that is maximum sentence allowed under law in the state for those charges. Since it is his first sexual assault err obscenity charge it will be less, since it was already plead down…gotta go, have a great day!

    He wasnt sentenced today, he filed a plea. Sentencing is Nov. 29th.

    I think a couple years in jail and losing his job plus being sued is a fair price to pay for doing a dumb act.Who knows they may lock him up with Updyke.I could see him getting his face painted as most college kids get when drunk but a ball to face act imo way overboard.

    Lol @ the SEC… Idiot fans who are products of centuries of inbreeding, scumbag coaches who get trashed and slam their motorcycle off the road, and football players who don’t need to attend any classes (academic or otherwise), regardless of how many times they’ve gotten a DUI or possession charge.

    I gotta admit though, it makes for some exciting football.

    grattanstanford, I won’t even go into what I’ve seen at Notre Dame but needless to say it was far worse than what you’re describin the fans of the SEC bein and Pal from where I’m sittin you’ve got a lot to learn about other people; especially the good people of the SEC. Had it been just one trip to Notre Dame I would’ve said ok so what the hell but as it turned out it was more than one trip and with each trip I had my eyes opened a l’il more. By the end of the last trip I knew there was no way to come outa there without sayin a lot of prayers for those folks. You’re no better than I am and you really should take some steps back and look at how hypocritical you are. After you’ve done that ask yourself if it’s worth it or bein a child over. You may be surprised at what you come up with: you don’t want folks to criticize you yet you criticize them, totally unfair wouldn’t you say?

    I was reading a post by an Ohio State alum and fan conversing about how horrible Notre Dame fans were. I remember also southernpatriots relating a conversation on a CFT story months ago with one of the foremost radio broadcasters of college football games who said in all his travels and thousands of college football broadcasts, the worse fans by far, were the Notre Dame fans in South Bend.

    I have Notre Dame alums in my family and as neighbors. They also admit that truth and tell about what they saw Irish fans do.

    Excellent question. I spoke with several friends who practice law in New Orleans and they both answered similarly….

    Downing could have received 10 years but for the deal his lawyers made. He also would have to register as a sex offender. Orleans Parish prosecutors and Downing’s attorneys rushed around Criminal District Judge Karen Herman’s courtroom for more than an hour before emerging with a deal. The deal was struck at the last moment before the trial was to begin.

    With this deal, Downing will be “officially” sentenced to 2 years in prison, but Judge Karen Herman has recommended him for a first offender boot camp program. He will actually serve 10 months.

    Downing’s attorneys, Miles Swanson and Michael Kennedy, worked out the plea deal which saved his behind, err private parts.

    So, in review, no sexual offender registration. Ten months in a first offender boot camp, program. He reports November 29th.

    Well, I certainly appreciate you women calling out neauxgeaux44 for his bigoted comments. Bigotry is evil, no matter where it’s aimed.

    But the sad thing about neauxgeaux44 is that to people like grattanstanford, neauxgeaux44 is describing all folks from the South when he calls people from Alabama redneck incestuous trailer trash. So when you guys give him thumbs up for that kind of behavior, the mud you’re slinging at other Southerners is just flying back in your own faces … as it should.

    I love it when people base the actions on one dumbass as confirmation on the way an entire state / fan population behaves.
    Been to Alabama many times for the Talladega race, ran into some drunk rednecks (and they weren’t all from Alabama) and ran into some really nice folks too (again not all from Alabama). Husband and son were recently at the Alabama / Michigan game – same scenerio, for all the people they came across only a extremely small percentage were idiots.
    If we take anything away from this, it should be a reminder to ourselves that we do indeed represent our fan base, and behave accordingly.

    I’m a LSU fan but this is beyond a football game. No one has the right to do something like that. And, I really don’t think anyone understands how dehumanizing that could be. And, I don’t think the fact that he was passed out drunk gives anyone the right to do what this man did. Now, I know this doesn’t reflect the quality of the students which attend the university of Alabama, or the fans which while, devoted thier very classy. But, I strongly disagree with anyone that doesn’t think this is serious, or somehow wants to assign blame to the victim.

    I’ve condemned Downing on countless articles prior to this one, called this out as a sex offense, and said he should receive the full measure of justice for his obscene behavior. As a rape survivor myself, I imagine I take these kinds of things a little more seriously than you do, and I don’t see anyone blaming the victim. I do, however, see some LSU fans using the behavior of one individual as an opportunity to call out the entire state of Alabama as incestous redneck trailer trash and other LSU fans giving them thumbs up for that while railing at a Notre Dame fan for damning the SEC. So apparently it’s okay to damn the entire state of Alabama for one person’s behavior, but not the SEC. The, um … shall we say “fluidity” of the CFT morality code never disappoints.
