From purely a legal standpoint, a person cannot obtain consent from someone that is intoxicated. If she was intoxicated, and one of them had sex with her, consent was not legally obtained and that person has comitted rape according to the law. Drunk hook-ups happen all the time. They almost never end in a rape accusation. False rape accusations (statistically) are pretty much non-existant. That is a myth generated by people looking to protect the reputation of perpetrstors when the stskes are high (e.g. high profile football players). Having said all that, they are innocent until proven guilty so we should all reserve judgement either way until the legal process runs its course. We should certainly refrain from blaming the girl and assuming that she just had regretted sex. That is irresponsible.

If the “alleged” victim gets to remain nameless, then the “alleged” suspects should also be a secret until charges are filed. There will end up being zero charges in this case, but these guys will still end up rapists in some people’s minds because their names have been all over the news.

There is nothing in the details that suggests a crime occurred. Three participants but for reasons totally unclear only two of them are being held responsible for what appears to have been a consensual act by all three of them.

It infuriates me when women who have regret for their actions after a booze filled night claim to be a victim. It diminishes the real problem of sexual assault on women.

She got drunk and invited 2 football players back to her hotel room. If not sexual acts, what was she expecting they were going to be doing? Reading verses from the bible in the nightstand?

A hangover mixed with shame and regret is a constant reminder of the previous activities. I’ve never accepted selective memory as a line of defense. She was absolutely aware of what she did and with who. It does not justify the activity of these men to say the least. They should know better than to be put in that situation. But I do agree that the efforts to add shame to the lives of these young men should also be afforded as a mending process if they are found innocent.

I was wondering what her complaint is. Did the player rape our force himself on her? Did the other player refuse to stop watching? All it says is she had sex with one man while another watched. To me, that’s really strange, but not a crime if all three consented. There is not enough story out to publicly destroy the reputations on the players. Of course, maybe there is a reason why there are no details.

On the face of it, this appears to be a he said/she said sort of thing. The kids should have known not to do this sort of thing, particularly while representing their team, but a crime?

Unfortunately so many women are abused and are unable or unwilling to report it that it’s a good thing we rush as a society to the defense of the woman aka “victim” but when we are wrong we drag down the names of students. Similar to the coach who was arrested for child pornography but it was just his own children in a family atmosphere where the mother was fully aware and complicit of the fathers pictures. It’s a good thing we detest the crime, but when the person is innocent, it’s unfortunate that we condemn so quickly. Hopefully, everyone has a short term memory and this doesn’t stain either boys’ name just like the coach’s name shouldn’t be stained either.

Apparently this is beyond my ability to understand, or something significant has been left out of the story. What I read was that a “woman” who had multiple alcoholic beverages – “at least four” – was socializing with two UT football players at a nightclub. The woman then INVITED the football players back to her hotel room. She thinks one of them had sex with her, but doesn’t remember the “situation” in detail.

How are two men “at the center of a sexual assault case” after the woman making the complaint admitted to drinking heavily while voluntarily socializing with the men, and then INVITING them to accompany her back to the hotel and then into her room??? They didnt force her to consume alcohol, didn’t force their way into her hotel room, and if she “can’t remember the situation in detail” how does anyone know the sex wasn’t consensual? Something just isn’t right.
