NCAA says Paterno family lawsuit is “fatally flawed”

Stop me if you have heard this before. The NCAA says a lawsuit filed against them is fatally flawed and wants it to be thrown out. This time the NCAA is making this comment about a lawsuit filed by the family of the late Joe Paterno, the former Penn State football coach.

According to the Associated Press, the NCAA says the Paterno family lawsuit, filed in a Centre County court, contains¬†“sundry misdirected complaints.” The NCAA believes the plaintiffs do not have the grounds to challenge the consent decree the NCAA had Penn State agree to prior to issuing sanctions against the program in the fallout of the Jerry Sandusky scandal. The NCAA slammed the university with a four-year postseason ban, massive scholarship reductions, probation, the vacating of over 100 wins from the record books and a $60 million fine designed to go toward child abuse awareness and prevention programs.

Earlier this week the NCAA agreed to restore a significant number of scholarships to Penn State’s football program, but at this point there has been no indication any other sanction terms will immediately be addressed. Because Penn State president Rodney Erickson signed the consent decree with the NCAA, the university was stripped of any right to challenge the sanction terms. The Paterno family opted to take on the fight on behalf of the university. The NCAA says the family along with faculty, former Penn State players and coaches are not the right plaintiffs for any legal battle related to the sanctions.

The NCAA has also been challenged by the Commonwealth of Pennsylvania in a separate, yet similar, lawsuit seeking to overturn all terms of the sanctions. There is also a separate lawsuit challenging the distribution of the $60 million fine money charged to Penn State by the NCAA. The NCAA has said all of these lawsuits are out of order.

    As I stated when the news came out that they were throwing a crumb at penn state in slowly reducing the scholoship sanctions which were and are illegal to begin with . I clearly stated this was nothing but posturing by the ncaa and mr emmeret to try and get the judge to toss the lawsuit in the upcoming hearing on october 29th, and whalla, two days later the dictator speaks of just that .
    He is going to say see your honor im working with them even though the sanctions were illegal. There doing such a great job of what they have always done so we decided to award them for never breaking any ncaa rules.
    All any ill informed idiot who continues to bash the school only needs to punch up on the internet which I know they know how to use because they comment on here all the time is, pennsylvania state university. They will see they have the 3rd largest endowment behind texas and i believe usc,but they have the largest profit margin, they will also see that there science and research dept brings in more money then most small football teams , then they can go on to read all the awards and accolades given to penn state , then there is thon and numerous other charity run organizations by the students that all raise money for kids in need whether money or medical etc. which they have been doing for ever. There hersey medical campus is the one who had the student find the break threw idea on using hiv cells as a cure for cancer. Then there is there outstanding student athlete graduation percentage that they battle with stanford and boise st each year for tops in that catagory.
    And they dont compare them academically with ivy league schools and say they are a state funded one,or that each year they are among the best rated schools to attend as far as campus life goes and best tailgating honors or the fact they were voted the best stadium to play a road game in by opposing coaches. So for all the idiots that say and write what they here that penn state was a football culture is absord and couldnt be farther from the truth, and if they are then every major college football team is and there are ones that when it comes to football make penn state look like saints. And then there is the qoute by mr emmeret himself that football is a neccassary evil in order to help fund other sports that schools other wise could not which allows for many more student athletes to get a scholorship and therefor an education they wouldnt have been able to afford. And last but not least if you dont know what the we r penn state thing is then dont try and label it.
    It starts with the student section that yells to the other side of the stadium to mostly alumni ,we r , and the response is penn state , this is done 3 times followed by thank you from the students and your welcome , again by alumni family and friends ,it has nothing to do with being a football culture.
    And show me anther school that has there band play the opposing teams fight song and school song.
    The students are all very polite and well mannered towards adults and family , they dont destroy stuff before or after big games, like lets say ohio st and michigan.
    In fact after the michigan game the university president put out a statement ,dont expect to see a ton of night games because of all the student arrests and ejections from the game and the destructon, he even went on to say its bad enough during a day game . But thats not a football culture.
    But hands down the sec conference has everyone beat by far.And I still dont blame miami or usc for complaining about sanctions or even ohio st when sec teams have been caught doing ten times worse and got probation ,now thats a joke, and shows its not what u do but who u know and well u can fill in the last word that starts with a B

    Hope the NCAA loses this suit and gets a well deserved ass-kicking.
